Terms of Service

These Terms of Service ("Terms") govern your access to and use of Shopping Assistant (the "Bot"), a Discord bot operated via the Discord platform. By inviting the Bot to a server or using any of its features, you agree to be bound by these Terms.

1. Description of Service

The Bot is an image-driven shopping assistant. When a user sends an image in a Discord channel where the Bot is configured, the Bot:

• Searches for matching products using a third-party image search service;
• Lists matching products on a third-party e-commerce platform; and
• Replies in the channel with a link to the listed product.

The Bot is provided "as is" for operational and convenience purposes only.

2. Eligibility & Acceptance

By using the Bot, you represent that you are at least 13 years of age (or the minimum age required to use Discord in your jurisdiction) and that you have the authority to invite the Bot to the server in question. If you do not agree to these Terms, do not use the Bot.

3. Acceptable Use

You agree not to:

• Use the Bot for any unlawful purpose or in violation of any applicable law;
• Submit images that infringe the intellectual property rights of any third party;
• Attempt to overload, disable, disrupt, or reverse-engineer the Bot or its underlying infrastructure;
• Use automated means to abuse the Bot's rate limits or bypass its concurrency controls;
• Use the Bot to list or distribute counterfeit, prohibited, or restricted goods.

To protect downstream services and prevent abuse, the Bot enforces per-user concurrency limits and may queue or reject requests when limits are reached.

4. User Content

You retain ownership of any images you submit to the Bot. By sending an image, you grant the Bot a limited, non-exclusive license to process the image for the purpose of searching for matching products and listing them on the configured e-commerce platform. You are solely responsible for the content of the images you submit and for ensuring you have the right to do so.

5. Third-Party Services

The Bot relies on third-party services to perform its functions, including:

• Discord — the platform on which the Bot operates;
• Image search provider — used to find matching products from an image;
• E-commerce platform — used to list products and generate purchase links.

Your use of these third-party services is also subject to their respective terms and privacy policies. We are not responsible for the practices or content of these third parties.

6. Intellectual Property

These Terms do not transfer any ownership rights in the Bot or its software. The Bot's name, branding, and underlying code remain the property of their respective owners. Product images and data returned by the search service belong to their respective rights holders.

7. Disclaimers

The Bot is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the Bot will be uninterrupted, error-free, secure, or that search results or product listings will be accurate or complete. Product availability, pricing, and listing success depend on third-party services beyond our control.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Bot, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless the operator of the Bot from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Bot or your violation of these Terms.

10. Suspension & Termination

We may suspend or terminate access to the Bot at any time, without notice, for any reason, including violation of these Terms. You may stop using the Bot at any time and remove it from any server where you have the necessary permissions.

11. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be available at this page with the "Last updated" date above. Your continued use of the Bot after any changes constitutes acceptance of the revised Terms.
